YEAR END DATES OF INTEREST FOR YOU

Cancel the Scottsdale meeting Nov. 17 so that we can present  a great education class that will really help you in the short sale market. We will instead be at the WUSA Business Center for the presentation of the HAFA class for 3 hours of credit. STARTS AT 9 AM--GOES TILL NOON.
 
Also, no meetings on the 24, 25 or 26 of Nov.
 
Then on Fri. Dec. 3, I have cancelled the regular meeting to allow everyone to be at the Social Networking class at WUSA Business Center, from 9 till noon. GET SIGNED IN FOR THIS ONE, IT WILL SERVE YOU WELL NEXT YEAR--THIS IS A CRITICAL CLASS. AND, it has credit hours!
 
Dec. 7, I believe we have an accountant to speak of taxes for you and Jan Roberts of ARMLS speaking on I-MAPP. Should be a super meeting and is the once a month meeting for Ahwatukee.
 
The 8th of Dec. will be Scottsdales Holiday Party starting at 5 PM--followed by Ahwatukee on the 9th at 11 AM. Next day on the 10 will be Mesa's party at 2 PM. And then Arrowhead will have a party on the 16th at 11 AM. It will also be the last meeting of the year for offices, to be resumed again on Jan. 4th at Ahwatukee.
 
On the 14th of Dec. is the super meeting for Mesa and Ahwatukee, at SEVRAR. Starts at 9 AM with a regular office meeting, then lunch and then a 3 hour CE class. This has been put together by American Title and should be a great one. This then cancels out the Dec. 17th meeting at Mesa.
 
There is also a new agent orientation on the 8th of Dec. from 10-12 at the WUSA Business Center.
 
This is what I have on my calendar for the rest of the year so you can get ready for 2011.

In August of 2010, FBS, Creators of flexmls, installed a new feature that will automatically expire unopened Auto Email Events. This feature will pause the sending of auto emails to someone who has not opened any of them in the last 90 days. The first round of auto expirations is set to happen on November 18, 2010.

Starting on November 8, notifications will be sent each Monday to those Agents with email events nearing expiration. Please read more to be reminded of how to act on those alerts.

I have had several agents reveal to me that they do not turn in short sale contracts--UNTIL THE BANK GIVES THEIR APPROVAL!
In that case, you are then several months overdue on submitting them to WUSA for broker approval--which must be done within 5 days of becoming a contract--ie: buyer and seller have executed the contract. This is per ADRE 32-2151.01 G. So you see, it is a law!
 
So, how do you handle a deal that is NOT a short sale? Do you wait until the bank gives approval for the loan?
Of course not and nothing is different in a short sale--So turn in the paperwork ASAP so the broker can review and initial it within 5 days of the executed contract.
This goes for Buyer Broker Agreements also
AND rejected offers (which must be held in a file for at least 1 year)

MLS PRINT OUT

NO--IT IS NOT A CONTRACT
Between the buyer and the seller!
 
I am talking about the MLS printout!
And this email is for those that do not know this.
 
Week after week, we brokers again explain this issue. Last month, I talked to someone who has been in the business for a couple of years and also a 40 year veteran.
They both believed that since the MLS says certain appliances go with the property then  there is no need to write it into the contract.
They are both wrong and now have a new problem to face with their buyers since they represented that the appliances go with the property.
And here's another one--the MLS says that no SPDS or CLUE report is available and then write a contract for a client that states--there WILL be a SPDS and CLUE report. Another pilot error!
The only part of the MLS printout that is a contract is the compensation offer--from the listing broker to the selling broker--and that has nothing to do with the buyers and sellers transaction with each other.
SO, do not ABSOLUTELY rely on the MLS info.
Verify anything that is important and write it into the contract.
 
My advice--think before you write contracts or you may be writing a check next.

POSSESSION AFTER COE

POSSESSION!
 
It has many times been a last minute monkey wrench in a property closing and as we see short sales closing, there is far less motivation for sellers to move out on COE
and some don't. They typically get no money from the transaction and sometimes don't have the means to move. When they do get a certain amount for moving, they may have to wait for closing to get a check, rent a new place, get a truck and move which might take several days.
Possession is an issue that should be worked out way before closing but seldom is except the usual contract clause regarding possession.
We had buyers last week that closed escrow but the sellers wanted 2 extra days to get out. This all came about at the COE. The sellers agent told our agent that sellers always get 2 days to move. NO, THAT IS NOT TRUE! If they get extra time to move, then it must be agreed to in writing and that would be per Az. law R4-28-1102 J and then add in K.
So in this case, the buyers are suddenly the bosses and demand $75 a day for rent--BUT the sellers claim that $30 a day is enough. So if no deal is made, then the sellers have contractually agreed to move at COE. So our agent asks if we can call the Sheriff to take them out of there.
The answer is NO--the sheriff only acts on court orders. So the buyers would therefore have to initiate a forcible detainer action in court, obtain a judgment and then execution of the action, if necessary, by the sheriff. This probably takes 3 or 4 weeks. Does this damage the buyers--I would think so and they need to consult with an attorney to recover their damages.
But, as happens in so many cases, the sellers move in a few days and no further action is necessary except the recovery of damages. (In this particular case, they signed the agreement for $75 a day)
However, the buyers probably need to take the necessary steps to begin the removal of sellers and start the process immediately when they don't vacate the property.
The preceding scenario is not something that we can predict accurately but it is sometimes a factor in any closing of property. 
Consider the factor of possession when the contract is written.
Also be sure of what is included in the purchase and take pictures of it all--even the window coverings, fans, appliances and so on.
Last week, we had a potential switcheroo nearly happen but it was discovered in time and the agents set it straight. The sellers had new appliances and the old ones were in storage.
And something else--if you sell a house that has one of those "contractor lok-boxes" please know and remember that every thief in town knows the codes to these things, so this is even more reason to take pictures of whatever is included in a sale.

THE OPEN HOUSE CAN BE AN EFFECTIVE STRATEGY

Now that realtors have access to the MLS listings on-line, some are questioning if the traditional method of holding an open house is still in fact viable. But is it still a worthwhile idea to spend the time and energy to have an open house? Consider that up to 48 percent of the property purchasers use the phrase open house in their search engine queries. Research illustrates that this proven practice remains an successful strategy, so it just makes sense to take advantage of the opportunity.

Of course, just putting an Open House sign on the lawn will not guarantee you the results you are looking for, so start setting up your action plan a few weeks in advance by posting on the internet and printing flyers. understanding which features are most critical to potential buyers will create a different open house strategy for a Brampton real estate agent versus other realtors in other cities. Evaluate the area and determine the best places to put up directional signs to funnel in traffic from the major arteries and side streets. A few days before the open house, boost up the attention by handing out flyers to the surrounding homes in the neighborhood. Make certain there is an announcement on the front page of your site and place notices in the local publication. Make the most of all your publications channels by creating fast and easy methods to direct the public to your current open house listings.
Once open house day is here, it is crucial to make the most of the opportunity. Meet the buyers at the doorstep and be friendly and educative. Try to prevent from pre-judging anyone who walks through your open house, as their appearance or race has no impact on their level of interest. Areas such as the Burlington Ontario real estate sector consist of a lot of different kinds of people which makes judging if a person can afford a home that much more difficult. They might actually be evaluating your methods to see if they want to use you as their agent. Instead of barraging them with typical sales questions pay careful attention to what they have to say and respond with specific questions that show you are paying attention to their requirements.
In a lot of the real estate courses that you have attended over your career you have certainly been informed that if a home stands out to the potential purchaser it has a better potential to sell. Once the visitors have toured the open house, you need to make sure you offer them some easy-to-carry handouts that will prompt them to remember your property and your property because they may view numerous houses in a single outing and you want to assure yours will stay fresh in their minds. If you are able to create a complete handout to the neighborhood that also provides useful tips on searching for a home you have a much greater possibility of hearing from them again. In this handout you can also include information regarding properties that are in a similar price bracket, even if they are not represented by your brokerage, so they can do their own comparisons. Offer maps of the area and simple internet links that will guide them to detailed facts on the web. You should keep in mind the reality that an open house day can have a return on the investment, and regardless if you do not see results the day of the event, the energy you put into making it properly can pay off later on.

Commercial Turnaround Likely Next Year
Vacancies are still increasing in many parts of the U.S. and new commercial construction will be sparse this year, Kermit Baker, chief economist for the American Institute of Architects said Wednesday.

“There are a number of factors at play here that are contributing to one of the steepest construction downturns in generations,” said Baker. “We have businesses nervous about expanding their facilities, a fragile financial sector, excess commercial space, and general unease in the international economy.”

He predicted that demand for retail, hotels, healthcare, and recreation facilities will result in a turnaround in 2011.

OUTLOOK EXPRESS ADDRESS BOOK

I have an XP operating system in a computer and I love the Address Book. I am able to take people from the main menu and put them in groups very easily. Then I am also able to transfer from one group to another at will--just click on Select Members and transfer them from the 2 windows that come on. Perfect and easy!
 
So on my other BIG computer that has VISTA is something called Windows Mail. It is impossible to do the same thing with this. I really need to be able to transfer names around and I have over 1200 of them sorted into over a dozen groups. What a PITA this is and takes countless hours to accomplish when I have to RE-TYPE all the names when I want to change their positioning.
How can I get the slick XP address book functions over into Vista?
I am desperate for an answer to this!

House OKs extension of tax credit closing deadline
Senate could vote Wednesday

In a 409-5 vote, House lawmakers have passed a standalone bill that would extend for three months Wednesday's deadline for closing on a home purchase in order to claim the federal homebuyer tax credit.
The Senate could vote on the bill, HR 5623, as soon as tomorrow, although the death of Sen. Robert Byrd, D-W.Va., has slowed the pace of work in that chamber.
Without an extension, the National Association of Realtors estimates as many as 180,000 homebuyers who were under contract by April 30 may miss the June 30 closing deadline, including 17,700 in California, 15,340 in Texas, 14,830 in Florida and 9,130 in New York.
"Keep your fingers crossed," said Lucien Salvant, an NAR spokesman, who said prospects for quick passage of the bill are mixed.
While some observers think HR 5623, "The Homebuyer Assistance and Improvement Act," could sail through without further delay, there's no guarantee it will come to a vote, Salvant said.
The Senate is already on record supporting an extension, having amended a bill on June 16 to push the deadline back to Sept. 30. But other provisions of that bill, the "American Jobs and Closing Tax Loopholes Act of 2010," have proved controversial, prompting House lawmakers to introduce a standalone bill.

Bill Extending Tax Credit Closing Deadline Falls Through in Senate

An amendment that would have extended the closing deadline for the home buyer tax credit by three months failed on the Senate floor this week.

Senate Majority Leader Harry Reid (D-Nevada) proposed the extension, and the amendment itself was approved by a large margin last week as an add-on to H.R. 4213, the American Jobs and Tax Loopholes Act.

Republican senators, though, defeated the full measure on Thursday, for the third time, when Democrats moved to end debate and push it to a chamber vote. Reid has indicated that after three unsuccessful attempts, he plans to drop the matter altogether.

The amendment would have extended the tax credit deadline for closing on a home purchase to September 30. The current deadline is June 30.

The National Association of Realtors (NAR) says some 180,000 homebuyers who signed contracts in time will not be able to make the June 30 closing deadline, simply because of the time it takes for lenders to complete transactions. The trade group estimates that 75,000 of those who will miss out on the tax break are buyers of distressed properties.

NAR says its members have reported that as many as one-third of qualified applicants have already been notified by lenders that their mortgages will not close before June 30, due to the sheer volume of applications in the pipeline.

The tax credit amendment was just one piece of the multi-faceted bill that was primarily intended to extend unemployment benefits for Americans out of work for more than six months.

Republicans rallied against the measure on the grounds that it would have added $30 billion to the “already staggering national deficit,” they said.

Here is an email that I got from Pam Herrington of Prospect Mortgage. This is exciting info and we just have to wait for it to become law, and I hope that is soon.
It is tied into the NFIP Insurance program bill that is waiting to be passed .

This is good, but the key is that they needed to be under contract since April 30 and if they are having to wait five

Months to close!  Wow!  BUT it is a good move…too bad they didn't just bring back the actual Tax Credit.  Oh well.

This will help those that are having challenges getting their deals signed off from sellers and selling banks.

Senate Approves Closing/Funding Date Extension until September 30th for Home Buyer Tax Credit Program

On Wednesday afternoon, the Senate OK'd a proposal to add three more months to the closing schedule of the tax credit program, extending the deadline until September 30, 2010.  The extension applies only to sales that went to contract by April 30.

The amendment has been strongly supported by the National Association of Realtors, who estimates that 180,000 buyers who had a contract in place by April 30 still would be unable to close on their home by the end of this month.

For the amendment to become law, the House and Senate must reconcile their bills. With the housing market still teetering, any move that may help sales numbers is likely to get Congress' attention.
