Many pets are being left behind in foreclosed homes and need help. Lost Our Home Foundation was formed by a group of Realtors to give that help. Now I am asking agents from West USA to join in and donate per the flyer that is attached.
Everyone that makes a donation will put their card in a hat so that a winner can be drawn for the grand prize--the collectible Dillards Bears from 2001 that you see in this picture. This will happen on September 3, 2009 at the Arrowhead office during the agents meeting there on Thurs. Toni Taylor of American Title is spearheading this effort. Please bring something in and leave it at any American Title office located at Arrowhead (Toni), Metro (Teresa), Scottsdale (Jill) and Mesa (Tiffany).
These are the ladies involved in this effort.
The Bears were donated by Bob Stephens.

Re:     UPDATE:  FHFA and GSEs Act on HVCC Concerns

Dear Fellow REALTOR®,

I am writing to you with an important update on NAR's efforts to address ongoing

problems with recent changes to appraisal rules.

 

As a direct result of my recent meetings with the New York Attorney General's office, the Federal Housing Finance Agency, and Fannie Mae, both Freddie Mac and Fannie Mae this week issued new guidance to all lenders on the Home Valuation Code of Conduct.

 

The alert clarifies two very important points that we raised in our meetings with

officials.  First, it states that lenders should use appraisers who have

clear experience in the geographic area.  Second, it clarifies that appraisers are

not prohibited from talking to real estate agents.

Although this is certainly a step in the right direction, more still needs to be done

to address problems with the HVCC.  NAR will continue to push for a moratorium

on the Code, and I will continue to meet with industry partners and officials to

convey our concerns.

PROTECTING TENANTS ACT OF 2009

Good morning--If a home is foreclosed on and there are tenants in possession of the property, this has always created hardships on tenants. On May 20, 2009, Obama signed into law S.896, Title VII-Protecting Tenants at Foreclosure Act of 2009. For an explanation of this situation, go to Attorney Andy Hull's web site www.doctorevictor.com  and when the home page comes on, click on the top that is printed in red. This will even provide the forms needed for the tenant and the new owner (usually a bank)

CLARIFICATION OF BBA

As I went thru offices this past month, I discovered that many agents are not aware that the Buyer-Broker Agreement (BBA) needs to be submitted to the office for Broker review and compliance with ADRE law, 32-2151.01 A,
Broker requirements; record keeping requirements. And of course D of this section;
All licensees shall promptly place all cash, checks or other items of value received as payment in connection with a real estate transaction in the care of the designated broker.
Some agents may believe that they can take money as a retainer fee and NOT turn it into the office. Please read the law book and there is one provided in each office for you--since that is also a law.
Turn ALL contracts into the office for filing!
